A 32-year-old Bulawayo man appeared in court charged with rape after he allegedly had sexual intercourse with a female juvenile aged 12 years who at law cannot consent to sex.
Manage Kamuka of 8th Street Makokoba, appeared before Bulawayo regional magistrate, Mr Mark Dzira, facing allegations of rape as defined in Section 65 (1) of the Criminal Law Codification and Reform Act Chapter 9:23.
He pleaded not guilty and claimed he met the girl in a bar and took her home. Kamuka was remanded in custody to March 6 for continuation of trial.
Prosecuting, Ms Hazel Ncube told the court that allegations are that sometime in February last year, the accused person proposed love to the complainant who accepted.
They began having sexual intercourse several times as lovers on different occasions. During the month of November the complainant ‘eloped’ from home to stay with the accused person and they began to cohabit, the court heard.
The matter came to light on February 25 2026 and at around 2:30PM when Constable Zulu and Constable Singo were investigating a case of theft and the complainant was a suspect.
During the interviews with the complainant, it was established that the accused person had been having sexual intercourse with the complainant who under law cannot give consent.
The accused person was subsequently arrested and escorted to Mzilikazi Republic Station.
The complainant was referred to the hospital for medical examination and the medical report will be produced in court as an exhibit.
