Another application dismissed for illegal billboard duo

Two company directors accused of erecting a billboard denigrating a property developing company in Borrowdale had their third application for exception dismissed.

Mark Strathen of Paragon Printers and Grant Russell of Fairclot Investments who are represented by Gwinyai Mharapara and Tafara Danana had filed for exception saying the facts of their charge did not disclose an offence.

However, magistrate Ms Sharon Rakafa dismissed the application saying issues raised in the application are triable.

The matter has been on the roll since 2021 owing to several postponements by the accused persons.

State prosecutor Shambadzeni Fungura has accused the duo of using delaying tactics to derail trial.

It is the State’s case that on December 10, 2020 in Borrowdale, Harare, the accused persons erected a billboard with damaging information on a property developing company.

The complainant made a report to the police, leading to their arrest.

The State alleges that the billboard was likely to interfere with the ordinary comfort or convinience of the complainant’s clients.
