A BID for freedom by jailed Police Assistant Commissioner Gidion Baloyi failed yesterday when the Harare Magistrates’ Courts threw out his application for bail pending appeal.
Baloyi was last week imprisoned for nine months for facilitating the release of a fraud suspect.
Harare magistrate Mr Elijah Makomo said his bail application had no prospects of success on appeal. Mr Misheck Hogwe of Hogwe, Dzimirai and Partners filed a notice of appeal against the magistrate’s decision to convict and sentence Baloyi. Mr Hogwe told The Herald that he would now appeal at the High Court.
“Yes, our application has been dismissed but we are now preparing to file a bail appeal at the High Court because we believe our client is a proper candidate for bail,” he said.
Baloyi, a senior staff officer at Police General Headquarters in Harare, was jailed for trying to protect Nevermind Kufakunesu.
Kufakunesu is a fraud suspect related to a police inspector based in Chivhu. Baloyi contravened provisions of the Police Act that make it an offence to act in any manner likely to discredit the force. He had pleaded not guilty last week but was convicted on overwhelming evidence. Baloyi instructed a detective inspector investigating a fraud case involving Kufakunesu not to detain him.
