Brothers fight over late father’s land

TWO brothers from Zimunya are embroiled in a bitter wrangle over their deceased father’s estate.

Albert and Godwell Katupira appeared at the Mutare Civil Courts before Mrs Annie Ndiraya last Monday.

They have been fighting over a plot that belonged to their father. The elder brother, Godwell, claims that he was given the plot by the local authority when his sibling, Albert, was still 15 years old in 1981.

Godwell is threatening to evict Albert and their old mother who seems to be siding with Albert.

Godwell told the court that he was given the plot by the local authority in 1981 and has every right to evict his brother and mother if he feels like.

“I was given this plot in 1981 when Albert was still 15 years old. So to tell me that it belongs to our late father would be a lie. If he thinks that he has grown up he should excuse himself. I am the father now and it is time he moves out together with our mother because my mother has been labelling me a bad person,” he said.

However, Albert said his brother was acting unfairly.

“I built my house on my late father’s plot in which he was left in charge since he is the elder brother and our mother agreed to that. Now he wants us out because he feels I am not respecting him. Inasmuch as our mother is old she still has a say on her late husband’s property.

“My brother and I fight on several occasions over the issue and I pray for a protection order for myself and my mother,” said Albert

Mrs Ndiraya granted the order and told them to go and resolve the land dispute at the local authority.
