He made the application for variation of his bail conditions after government officials approached him to assist the Industrial Development Corporation of Zimbabwe in the due diligence exercise.
Government, through IDCZ, wants to rescue the company from collapse hence Mutanda is the key person in the entire exercise. This comes after Cabinet made a resolution to take over all CAPS Holdings’ debts to save it from collapse.
Harare magistrate Ms Anita Tshuma allowed the defence application saying the deal between CAPS and Government was of national interest.
“Where the Cabinet feels that the Government should save CAPS from collapse, it becomes an issue of national interest,” said Ms Tshuma.
“Clearly from the documentary evidence, the IDCZ’s request to have a meeting with the accused (Mutanda) shows he has been identified as the one who can render assistance in resuscitating CAPS,” said Ms Tsuma.
Ms Tshuma said the new circumstances, which the defence proffered persuaded her to grant the application.
Prosecutor Mr Michael Reza had opposed the application saying Mutanda was not part of the due diligence exercise in view of the contents of documents, which were availed in court.
Mutanda is jointly charged with Justice Majaka in the high-profile fraud case.
They allegedly took 50 dossiers of critical drugs manufactured by the pharmaceutical firm before registering them in Europe under the name CAPS International.
