Thembinkosi Khumalo (43), of F28 Lusumbami Village, Hwange, was again not formally charged with criminal abuse of duty as a public officer when he appeared before Hwange magistrate Ms Lindiwe Maphosa.
Early this month his trial could not take off as his lawyer, Mr Tonderai Charles Mukuku, of Marondedze, Mukuku, Ndove and Partners, said he needed time to prepare his client’s defence case.
The court heard that on 20 July this year, Khumalo summoned Mafu Ndebele, a worker at Hwange Colliery Company to his office.
The State is alleging that he told Ndebele that he was facing serious allegations of aggravated assault, which he had perpetrated on Wisdom Mumba, a student at Hwange Government High School sometime in June this year.
Ndebele was alleged to have assaulted the boy with open hands and made him do some high jump and the boy sustained some injuries as a result.
Ndebele was shown a medical report.
Khumalo allegedly told Ndebele that the allegations warranted three months imprisonment and for him to avoid that he was allegedly given a note with a breakdown of the money which had to be paid.
The note stated that $300 was for the fine; stay of prosecution $100 and $100 for waiver of suspension pending discharge.
On 26 July detectives from the Criminal Intelligence Unit in Hwange received information that Khumalo was allegedly demanding money from Ndebele and a trap was set leading to Khumalo’s arrested.
