A BULAWAYO High Court judge has ordered the Civil Service Commission (CSC) to settle a four year-old debt amounting to more than $36,000 owed to a local motor company.
The debt emanated from the CSC’s failure to pay for motor spare parts procured by Ricnob Supplies (Pvt) Ltd for its fleet of buses imported from China at the commission’s request.
In court papers, Ricnob Supplies is the applicant while the CSC was cited as the respondent.
Justice Martin Makonese’s ruling follows a chamber application for default judgment filed by Ricnob Supplies seeking an order compelling the CSC to pay $36, 213 for the spare parts. “Judgment be and hereby granted in favour of the applicant. Respondent be and hereby ordered to pay applicant $36,213 representing monies for spare parts purchased by applicant for respondent’s FAW buses in November 2011,” ruled Justice Makonese. The judge also ordered the CSC to pay legal costs incurred by the motor company.
Ricnob Supplies through its lawyers T Hara and Partners said it entered into an agreement with the CSC to supply the civil servants body with spare parts for a fleet of buses.
It said the CSC was supposed to pay $55, 783 for the parts as per agreement.“Sometime in November, 2011, the CSC through its manager in charge of buses, requested the supply of spare parts for its FAW buses and Ricnob Supplies procured the consignment from China,” said the motor company’s lawyers.
The company said CSC breached the contract by failing to pay the full amount despite acknowledging the debt.
