Destructive ritual in fight over family home

A BULAWAYO man is living in fear after his uncle whom he is entangled in a battle over the control of his late aunt’s house allegedly performed a destructive ritual at the property in question’s doorsteps supposedly in a desperate move to scare him away.

Ntando Ndlovu from Riverside suburb opened up before magistrate Franklin Mkwananzi at the Bulawayo Civil Court accusing his uncle Sipho Ndlovu of disturbing his peace at his late aunt’s house when he planted a flower at the doorstep before he covered it with a red cloth with two needles pinned on it.

As if that was not enough and in a desperate bid to force him out of the house, Ntando said his uncle also brought into the house a dysfunctional refrigerator filled with “rotten” meat.

“I started staying at the house in question in June 2013 with my aunt until she passed on 2 October last year. She left behind no children and she was also not married. After her burial all the relatives agreed that I should keep staying at the house until the finalisation of her estate, except for my uncle Sipho Ndlovu who has been showing interest in the deceased’s property.

“On 31 December my uncle and his wife jumped over the fence and returned the property which they had forcibly taken on 6 October. My uncle went on to take a red cloth and two needles and crossed them over a flower which he had planted on the doorstep making some declarations that they will fight against me,” said Ntando.

He said his uncle went on to declare that the house would be for him and his family and he wanted him out of it.

He added: “He took the keys, bank cards and identification particulars of the deceased. On 13 January he jumped over the fence again and brought a malfunctioning refrigerator with beef inside and left it in the house. After some days the spoiled meat started giving out a stench smell which pervades the whole house. I reported the matter to the police who referred me to this court for further assistance.”

He pleaded with the court to grant him a protection order that stops his uncle from visiting the property in question saying he was threatening to bewitch him.

In response Sipho didn’t refute his nephew’s accusations. He in fact accused him of being ungrateful.

“The applicant (Ntando) is my elder sister’s son. I have helped him a lot in his life. We are currently processing the deceased’s estate. The deceased is my sister and the house in question is mine as we have agreed with the family.

Indeed I planted the tree and placed the cloth and needles on top and said what I wanted because the house is mine.

I can do what I want with it. Currently I am staying in the rural areas and the estate is being handled by lawyers,” he said.

For the purpose of maintaining peace between the two parties the presiding magistrate Franklin Mkwananzi ordered Sipho not to threaten, verbally and physically abuse his nephew and not to visit the house in question until the estate is wounded up.
