Firm ordered to pay back US$26 500

A Harare businessman Mr Cashington Mavhunduke entered an agreement with Tromage and paid US$26 500 to buy a Toyota Prado that was to be imported from Japan.
Tromage breached the agreement by not delivering the vehicle despite being paid.
This prompted Mr Mavhunduke to approach the High Court seeking cancellation of the agreement and a refund.
Advocate Lewis Uriri appeared for Mr Mavhunduke in the civil matter.
Justice Francis Bere granted a default judgment compelling Tromage to pay the money in question.
“It is ordered that summary judgment be and is hereby granted in favour of applicant against respondent in the sum of US$26 500.
“The respondent shall pay interest on the principal sum of US$26 500 at the rate of five percent per annum reckoned from December 20, 2010 to the date of payment in full.
“Respondent shall pay to the applicant collection commission in accordance with the law society by-laws,” read part of the order.
In default of payment, Tromage risks attachment of property that is equivalent to the US$26 500 together with interest.
On November 5 last year, Mr Mavhunduke entered an agreement of sale of the vehicle.
According to the agreement, Tromage was to procure the Toyota Prado from Japan and Mr Mavhunduke paid the full purchase price of US$26 500.
After receiving payment, Tromage undertook to deliver the vehicle within four weeks of the signing of the agreement.
Tromage breached the agreement and up to now, that vehicle has not yet been delivered.
Meanwhile, Tromage director Mrs Joyce Mukazhi is on criminal trial at the Harare Magistrates’ Court where she is facing fraud charges emanating from the vehicle deal.
