A BULAWAYO fuel company has taken Mbada Diamonds to court in a bid to recover over $40,000 in unpaid fuel supplies.
The debt emanates from the fuel which the mining company bought from JK Motors (Pvt) Ltd on credit six months ago.
JK Motors filed summons at the Bulawayo High Court citing Mbada Diamonds as the defendant.
The company accused Mbada Diamonds of breaching the terms of their agreement by failing to settle the money within the agreed timeframe. “In
December 2015, the defendant purchased fuel from the plaintiff on account which amounted to $40,352,68,” said JK Motors.
The fuel supplier said it was struggling to recover the money from Mbada Diamonds.
JK Motors is seeking an order that compels Mbada Diamonds to pay $42,404,17 and the cost of suit at attorney-client scale. “Wherefore the plaintiff claim is for defendant to pay $42,404,17 in respect of the fuel supplied to the defendant through a credit facility that it has with plaintiff.”
Mbada Diamonds has not yet filed opposing papers.
Last year, a local mechanical engineering company, Warman Zimbabwe (Pvt) Ltd, took the diamond mining company to court for failing to settle a debt of more than $800,000 accrued over a period of five years. The debt emanated from mining equipment and accessories, which Mbada Diamonds bought from the engineering firm on credit between January 2010 and June 2015.
