Gay man insists on inheriting late ‘lover’s’ house

A Victoria Falls man who is refusing to vacate a house he was sharing with a man who is late, claiming the deceased sodomised him for 19 years and infected him with HIV, has been dragged to court by the deceased’s widow.

Christina Sibanda, 38, who is the widow of Masiye Moyo, who was a boat captain at the now defunct United Touring Company (UTC), is seeking an order to evict Bruce Kazembe, 32, from the house in Chinotimba.

The case was briefly heard yesterday and Sibanda told Victoria Falls magistrate Rangarirai Gakanje that she cannot access the house as Kazembe has occupied it claiming the late Moyo offered it to him to buy his silence for the alleged abuse.

Moyo died on May 19 this year, leaving the widow who is the estate’s executor and four children aged between five and 15 years.

Kazembe says the four-roomed house in Chinotimba suburb is now his.

“I was married to the deceased for 17 years and we had four children. I want the person who is staying in the house to move out. He has been living there since my husband died and I’ve been failing to access the house. He’s not even talking to us and each time we go to the house we don’t find him,” said Sibanda.

She said her late husband assumed ownership of the house from his employers in 2012.

“I’ve the keys and I don’t know how he got in,” said Sibanda.

The magistrate deferred the matter to July 30 when Sibanda is expected to provide proof that she is the executor of the estate before the hearing can proceed.

Kazembe attended the hearing and was only asked to confirm that he was the defendant in the matter, which he did.

Sibanda has also pressed separate criminal charges against Kazembe, saying he broke into the house and stole some property.

Kazembe has vowed to stay put.

“Masiye sodomised me since I was 11 years old and I contracted HIV in the process. I’m surprised I’m being evicted because he offered me the house so that I don’t reveal the abuse. I’ve been disowned by my parents and the court should consider my status. I can’t fend for myself and I can’t marry anymore,” he claimed in the notice to plead.

When The Chronicle spoke to Moyo before his death, he vehemently denied the allegations, saying he was shocked by Kazembe’s claims.
