A 34-year-old Harare man has appeared in court on allegations of stoning to death a good Samaritan who was trying to reprimand him from physically assaulting his wife.

Malvern Batsirai was not asked to plead to murder charges when he appeared before Harare magistrate Mr Dennis Mangosi.

He was remanded in custody and advised to apply for bail at the High Court.

It is the State’s that on November 5, at Killian Court in Harare, Batsirai was assaulting his wife Nomatter Makoro over an undisclosed domestic dispute.

The court heard that the now deceased Malvern Paul then tried to refrain Batsirai from further assaulting Makoro.

This did not go down well with Batsirai and a misunderstanding ensued between them.

The court heard that Batsirai and Makoro proceeded to Gail’s Court as they continued quarrelling. Upon arrival at Gail’s Court, Batsirai allegedly teamed up with his other three co-accused persons who are still at large (only known by their nicknames as Gaza Cartel, Tsomu Tsomu and Darlington Dadza).

Batsirai and his accomplices started assaulting the now deceased Paul using stones and bricks several times all over his body. After committing the offence, the four left him laying helplessly on the ground. The now deceased was later taken to hospital where he was pronounced dead upon arrival.
