While in the warehouse, there was a power cut and it went dark. Mutawa then told the complainant in Shona that, “Dai kuri kare kangu ndatopedza kare” (During my past I would have finished by now).

While waiting for power to be restored, the complainant sat down and Mutawa moved closer to her and requested to be intimate with her.

The woman declined his request and Mutawa went on to sit on her legs, tried to kiss her but she stopped him.

The court heard that Mutawa also caressed the woman and she tried to scream but the accused person covered her mouth.
