Embattled Harare City Council is yet to reinstate finance director Mr Tendai Kwenda following a directive from the Local Government Board.
Mr Kwenda was suspended in 2017 before being recommended for suspension by full council with his contract having expired on February 28 this year.
At law the council should first reinstate him paving the way for negotiation of an exit package.
However, the council is yet to implement a clear directive from the Local Government Board for Mr Kwenda to be reinstated with full benefits.
Acting city spokesperson Mr Innocent Ruwende said: “The human resources committee will sit on that.”
According to a letter dated September 16, 2022 from Local Government Board chairperson Steven Chakaipa directed the office of Harare Mayor Jacob Mafume of Mr Kwenda’s reinstatement.
Mr Chakaipa said the Local Government Board met on September 10, 2022 and deliberated on council application to discharge Mr Kwenda.
“The board noted that Mr Kwenda applied the vehicle policy that was in operation at city of Harare and consequently turned down council application to discharge him.
“Accordingly the board through resolution number LGB012/2022 decided that council reinstate Mr Kwenda with full benefits,” he said.
Mr Kwenda has since written to council advising of his position to resume work as at October 1, 2022 while negotiating for his exit package.
Acting town clerk Engineer Phakamile Moyo turned down the request saying since Mr Kwenda’s contract expired the decision by the Local Government Board can only be read and interpreted in the context of his expired fixed term contract.
“Be further advised that the entitlements that you cited in your letter have been referred to the Human Capital department so that they can look at them in line with your previous contract.
“As soon as they are done with their due diligence they will get back to you for your deliberations,” he said.
