The High Court has postponed the inquiry into the civil imprisonment order given to Property developer George Katsimberis who was ordered to pay US$10 535 to Pokugara Ecofriendly company and Kenneth Sharpe.
High Court Judge Justice Never Katiyo was about to conduct a full inquiry but was postponed due to the document of return of service that was missing from the file and the matter was postponed to November 25 for hearing.
Last week, the Registrar in the notice said he should pay the plaintiff’s the money being taxed costs and charges virtue of a judgment obtained against him in the High Court on November 30, 2020.
“You, the Defendant (Katsimberis) is hereby called upon to pay to Plaintiffs the sum of USD 10 535.00 being taxed costs and charges of the above mentioned,” the Registrar wrote.
The Registrar said if Katsimberis failed to pay he must appeared before the High Court this October to explain why he had not paid it and show cause why a civil imprisonment should not be issued on his account to failure to pay.
“If you fail to pay the sum specified above, you must appear before the High Court at Harare this October 2022 to explain why you have not paid it and show cause on why a civil imprisonment should not be made on your account of your failure to pay.
“You should bring evidence of your financial position it will be in your own interests to give the Court evidence of your position and it will be (2) your income receive from any wages, salary and other earnings and any other income you may receive other source ( you should bring wage slips or other proof of your expenses for as yourself and dependants, bring documentary proof such as accounts for school fees, insurance policies, Other labilities to which ; you may be subject into your financial position,” the Registrar wrote.
The Registrar said the court will conduct an inquiry into his financial position and depending on the circumstances saying it can commit him to prison saying he can give time to pay instead.
The Registrar further said he can approach the plaintiff’s to organise a settlement and failure he might be committed to prison or having his personal attachment issued against him.
Recently he was also ordered to pay the plaintiff he caused the matter to be postponed and Justice Jacob Manzunzu ordered him to pay the costs.
