Businessman and former Dynamos Football Club secretary Mr Brian Kashangura’s wife Gilliet Sarudzai Kashangura nee Motsi is being charged together with Zvichapera Nyamadzawo for allegedly attempting to strip the former of co-directorship in Brendon Security.
The two denied the charge when their trial opened before regional magistrate Mr Noel Mupeiwa.
The duo, through their lawyer, Mr Motsi Sinyoro, applied for exception to the charge arguing that it does not disclose an offence of fraud, which the prosecution strenuously opposed.
Mr Mupeiwa dismissed the defence application and the trial proceeded with the complainant Mr Kashangura, who recently graduated from a wheelchair to crutches testifying on how his estranged wife allegedly connived with her co-accused to defraud him of the shareholding in the company.
After testifying for two days, the magistrate deferred the matter to April 11 for the defence to continue cross-examining the witness.
In her defence outline, Gilliet denies the allegations against her claiming that she and Kashangura were in the process of divorcing in the High Court.
To this end, the charges and prosecution were part of harassment to fix her.
Charges against Gilliet and Nyamadzawo arose after the lawyer allegedly stripped the former’s husband of the shareholding in the firm and replaced him with Nyamadzawo and police Assistant Commissioner Erasmus Makodza.
According to the State outline, sometime in March last year, Mr Kashangura came up with the idea of forming a company meant to provide security services to private schools and registered Brendon Security on April 7 last year.
Sometime in June last year, the State says, Mr Kashangura fell sick and could not attend to his office.
The wife allegedly took over and acted in Mr Kashangura’s position, attending to all issues, which required his attention hence she was in charge of the safe.
Mr Justin Uladi of the Attorney General’s office is prosecuting.
