Magaya’s ConCourt bid dismissed

PROPHETIC Healing and Deliverance Ministries founder Prophet Walter Magaya, who is facing multiple rape allegations, has had his application to refer one of his cases to the Constitutional Court dismissed.

Presiding magistrate Mrs Estere Chivasa ruled that Magaya’s application did not meet the constitutional threshold required for referral and that the matter would proceed in the Victim Friendly Court (VFC) to ensure the protection of vulnerable witnesses.

The dismissed application was part of Magaya’s legal strategy, but magistrate Chivasa maintained that there were no substantial constitutional issues warranting Concourt referral.

The case is set to return to court today for further management.

In a separate case before regional magistrate Mr Francis Mapfumo, Magaya is defending his application to refer the matter to the High Court.

The prophet is accused of raping three congregants on multiple occasions between 2013 and 2018.

The State alleges that Magaya raped the first victim three times in 2013, the second victim once in 2016, and the third victim twice in 2018.

Magaya argued that his constitutional rights have been violated, particularly citing the withdrawal of charges by one complainant.
