Man jailed 3 years for attempted murder

A MAN who axed his neighbour for accusing him of having an extra-marital affair with his wife, was yesterday sentenced to five years in jail.

Dumisani Moyo, 29, of Fincham village in Inyathi was convicted on his own plea of guilty to a charge of attempted murder by regional magistrate Chrispen Mberewere.

Moyo will, however, serve an effective three years in jail after two years were suspended for five years on condition that he does not within that period commit a similar crime.

Mberewere told Moyo:

“You’re a first offender who was remorseful and did not waste the court’s time. However, despite that you committed a serious crime, a sentence excluding imprisonment would certainly trivialise the seriousness of the crime. You therefore deserve a custodial sentence.”

Prosecuting, Trust Muduma, said on September 14, 2014 shortly after midnight, the complainant Mkulunyewa Mpunzi went to Moyo’s homestead after he heard a rumour that Moyo was dating his wife.

Mpunzi confronted Moyo accusing him of having an affair with his wife.

The court heard that Mpunzi charged at Moyo before he stormed into his bedroom.

“Moyo got angry and struck Mpunzi with an axe three times on the head and he fell down and lost consciousness,” said Muduma.

Mpunzi was rushed to Mpilo Central Hospital. A report was made to the police leading to Moyo’s arrest.
