A Shurugwi man who sodomised a mentally challenged herdboy has been sentenced to 10 years imprisonment.
The man, Timothy Mutanga, 32, of Murefu Village, under Chief Ndanga had pleaded not guilty but was convicted due to overwhelming evidence by regional magistrate Morgan Nemandire.
Mutanga who was sentenced to 10 years, will however serve an effective seven years in prison after three years of the sentence were suspended on condition of good behaviour.
“Prosecuting, Emmanuel Matosi said on March 13, 2012, Mutanga followed the complainant to the pastures where he found him herding cattle.
Mutanga who claimed to be in a drunken stupor, approached the complainant who is mentally challenged and informed him that his cattle had strayed into his fields.
He then ordered the complainant to bend down so he could whip him as punishment.
Mutanga instead sodomised the complainant who later reported the assault to his brother. The matter was subsequently reported to the police leading to Mutanga’s arrest.
