adminA CHEEKY 28-year-old Bulilima man beat up his 72-year-old stepfather for having sex with his mother in the full view of his juvenile nieces and nephews.
Wiseman Sibanda of Mazwaligwe area struck the old man, Tshido Ndebele with an iron bar on the head.
He was convicted on his own plea of guilty to assault by Plumtree magistrate Joshua Mawere.
He was sentenced to eight months imprisonment and four months were suspended on condition that he does not commit a similar offence within the next five years.
In mitigation, Sibanda said he had once warned his step father against having sexual intercourse with his mother in full view of his nephews and nieces.
a�?I assaulted my stepfather because he is disrespectful. He engages in sexual activities with my mother in full view of my nephews and nieces who are juveniles.
a�?He has been doing this for some time and I once warned him but he didna��t heed my advice. I also banned him from sleeping at my mothera��s homestead because of the issue but he didna��t listen,a�? he said.
Prosecuting, Elisha Mazorodze said Sibanda met the old man on February 26 around 10pm while he was on his way to visit Sibandaa��s mother at her homestead.
a�?Sibanda approached Ndebele while holding an iron bar and ordered him to turn back and return to his homestead.
Ndebele refused and insisted on proceeding to see Sibandaa��s mother.
a�?Sibanda further questioned him on why he was performing his sexual activities in full view of juvenile children. The old man refused to answer and indicated that Sibanda was a young man who didna��t have the authority to question him on his sexual life,a�? said Mazorodze.
He said as Ndebele walked away, Sibanda struck him with the iron bar several times on the head. The old man sustained injuries as a result of the assault.
Mazorodze said the matter was reported to the police resulting in Sibandaa��s arrest.
