adminThrough his lawyer, Mr Gerald Mlotshwa, a senior partner at GN Mlotswa and Company, Mr Militala said there was no single grain of truth in the claims made by the former workers in the letter they lodged with the Judicial Service Commission, the Master of High Court and the permanent secretary in the Ministry of Justice and Legal Affairs.
Mr Militala’s denial follow an article that appeared in Herald Business last Friday after the former DWTL workers petitioned the Judicial Service Commission to probe him.
Mr Militala has threatened to sue the four – Zachariah Gusha, Stephen Musapuri, Patson Mberengwa and Samson Thom – over their allegations.
The four, Mr Militala said, have since left the employ of the textile company after they were retrenched.
He added that all the 700 workers who remain on the company’s payroll fully understood the firm’s situation and would never make malicious statements.
Mr Militala was last year appointed by the High Court as the provisional judicial manager of DWTL after the company ran into serious financial problems.
On Tuesday Mr Mlotshwa dismissed claims that his client sold the firm’s assets and deposited the proceeds into his account without creditors or the court’s consent as alleged by the four.
“For the record, our client refutes each and every allegation as arises in your article. As indicated by the writer, the allegations are absolute nonsense,” he said.
“It is just as well that the paper published the names of the culprits party to this insidious piece of correspondence; wrongly addressed, we might add, to the Judicial Service Commission. Complaints regarding the conduct of persons in the position of our client are addressed to either the Master of the High Court or, as is more the case, the Council of Estate Administrators. Our client will be initiating the necessary, and very brutal, legal remedies available to him against each and every one of the signatories to the correspondence forming the subject matter of your article (published last week),” he added.
Mr Militala said although he remains the lawful manager of DWTL, any issues relating to matters affecting David Whitehead Textiles should first be addressed to his legal advisers, GN Mlotswa and Company.
