Harare City Council will continue disconnecting water supplies to defaulters until the court decides on an application by three city residents. The three residents on Tuesday had their urgent chamber application to bar Harare City Council from disconnecting water supplies to all residents over unpaid bills rejected.
High Court judge Justice Happias Zhou ruled that the application by Frazer Zvangundega Dube, Nelly Ndlovu and Beauty Sande was not urgent.
Justice Zhou said the validity of the relief sought should be decided through a court application.
The judge also said Dube, Ndlovu and Sande had water supplies to their homes disconnected at different occasions and they did not act with urgency as contemplated by the rules of the court.
He said the applicants should bring their case as an ordinary court application.
The three wanted council interdicted from continuously billing them until their court challenge has been determined.
The trio, through their lawyer Mr Sharon Hofisi of the Zimbabwe Lawyers for Human Rights, filed an urgent chamber application after council disconnected their water supplies in June this year.
The trio contend that water cuts were against their constitutional rights to clean and portable water.
Combined Harare Residents Association and Country Water Alliances had also filed their supporting affidavits, respectively.
