Vice President Constantino Chiwenga’s ex-wife Marry Mubaiwa, yesterday applied for refusal of further remand arguing that the State had failed to give her a trial date within a reasonable time as required by the law.
This came after prosecutor Mr Lancelotte Mutsokoti had applied for a postponement to allow the National Prosecuting Authority to analyse contents of a disc, which has important information needed in this trial since its password was found.
Mubaiwa, who has many cases before the courts, is facing money laundering charges in this matter.
Through her lawyer, Mr Ryan Sisitombe, Mubaiwa argued that Harare magistrate Mr Stanford Mambanje had given the State a last chance to furnish his client with a trial date, but the State has failed to do so.
Sisitombe told court that his client was not feeling well and must be allowed to be removed from remand.
“Since 2020, the State has failed to furnish the accused person with a trial date,” he said.
He submitted that the State would always summon the accused person back to court when its house is in order. Sisitombe told the court that he doesn’t know how many times his client should appear in court for her to qualify to be removed from remand. “We don’t know how long the NPA will take analysing the contents of the disc,” he said.
Mr Mutsokoti opposed Sisitombe’s application saying the case was complicated and required extra-territorial investigations, which they had no control over.
Mr Manuwere postponed the matter to October 28 for the ruling.
Mubaiwa was recently convicted of fraud after she tried to illegally upgrade her marriage with the Vice President without his knowledge.
