According to papers filed at the High Court, the authority represented by Sawyer and Mkushi law firm said it was a self-administered pension fund.
The authority submitted that according to Rule 9 of the Local Authorities Pension Rules, Zivagwe was obliged to remit employees pension contributions to the authority before the 14th of every month.
However, the authority said between February 2009 and November 14, 2010, Zivagwe Rural District Council breached Rule 9 of the Local Authorities Pension Fund Rules.
“It failed to forward and pay its employees pensions contributions to plaintiff (LAPF) resulting in an accumulation of arrears pension contributions amounting to US$12 450, 51 as at November 14, 2010,” LAPF submitted.
LAPF said members who breached the rule were required to pay interests prescribed by the management committee and the applicable rate is 1,5 percent per annum.
It further said of the amount US$12 334 49 was capital and the balance US$116,02 is interest.
Justice Andrew Mutema is set to hear the matter in due course.
