A suspected illegal land dealer from Chitungwiza yesterday appeared in court for allegedly selling a stand belonging to a deceased person without proper legal documents.
Blessed Tendai Mususa (34) appeared before Harare magistrate Mrs Ethel Chichera charged with fraud and was remanded in custody to January 3.
The State alleged that sometime in March this year Mususa took advantage of the fact that Francis Danga, who owned stand number 4070 Crowhill, Harare measuring 400 square meters had died. He then forged an agreement of sale of the stand, purportedly signed on May 12 2014 with Mr Danga selling him the stand.
Mususa advertised the stand for sale and he was approached by Lazarus Musamba who was seeking a stand in Harare.
Mususa told him he was selling the stand for US$7 000 and took Mr Musamba on March 21 to Crowhill, where he showed him the vacant residential stand. Mr Musamba was interested and negotiated to make payment using his Toyota Regius car valued at US$5 000 and US$2 000. Mususa received the vehicle together with its registration book and US$2 000 cash and both parties signed an agreement of sale.
Mususa surrendered the forged agreement of sale from Mr Danga.
On April 4, Mr Musamba went to the stand and started clearing it to build a cottage and received a phone call from Recado Danga who indicated that he was the executor of the estate of his late father Francis Danga which owned the stand in question and the stand had not been sold to anyone since the time of his death on 22 March 2014.
Mr Musamba first confronted Mususa who gave flimsy promises to resolve the matter and then became evasive, leading to Mr Musamba making a police eported.
Mususa was then arrested on 27 December by detectives and the Toyota Regius was recovered, leaving the US$2 000 to be accounted for.
