A LEGAL expert believes Zimbabwean authorities face many hurdles to effectively deal with individuals who post explicit on international social media platforms.
Weighing in on the ongoing debate about Queen Nadia, who has taken Zimbabwean Facebook by storm with her indecent posts, lawyer Farayi Zuva highlighted the challenges that could be faced by authorities.
“I think there are two problems that are coming to my mind that Zimbabwean authorities can face concerning online content.
“Number one is the lack of control over the platforms that are used to post the undesirable content.
“The lack of control comes in the sense that the most popular social media platforms, which this content is posted on, is outside the control of the Zimbabwean authorities.
“For example Facebook, X, formerly Twitter, Instagram, all those platforms are controlled from the United States of America.
“The Zimbabwean authorities face the challenge that they don’t have control over what Facebook allows to be posted on their platform and they have their own community rules and policies.”
Zuva added:
“That brings me to the second point which is the issue of differences in laws applicable or legal positions applicable.
“The laws that are applicable in Zimbabwe may not be the same laws that apply in America, UK, India or China.
“When Zimbabwean authorities then try to implement their laws which they have put in place, those laws are only applicable in Zimbabwe and international platforms are not obliged to confine themselves to those laws,” he said.
