However, Chigango was convicted of four counts of fraud after the State managed to prove its case beyond reasonable doubt.
Chigango had been initially sentenced to 24 months in prison of which four months were suspended on condition of good behaviour. The remaining 14 months were suspended on condition that Chigango performs 420 hours of community service at Rusape Metrological Department.
Ms Chiundura acquitted Chigango on three other counts because of insufficient evidence. Prosecutor Mr Gift Chokodza said Chigango, employed by Rusape Town Council for the past 20 years, committed the offences between July 2009 and January 2010.
Mr Chokodza said Chigango, among other duties was responsible for withdrawal of council funds, authorisation of expenditure, management of finances and monitoring and implementing financial systems in treasury.
On the first count Mr Chokodza said on July 31, 2009, Chigango withdrew US$14 408 from the council’s ZB bank account. The money was intended for workers’ salaries but he converted US$3 472 to his own use. Again on August 3, 2009, he withdrew US$15 464 meant for executive salaries and diverted US$1 200 to his personal use. He did the same in January 2010 when he withdrew US$5 500 and converted it to own use.   
Mr Chokodza said an audit unearthed the fraud and Chigango was confronted and failed to account for US$11 972. As a result, Mr Chokodza said Chigango breached the council’s procedures and resolutions of financial policies and accounting guidelines.
