Wife basher refuses to do community service, jailed

A 24-year-old Victoria Falls man who assaulted his wife for telling him to reduce the volume on his radio, has been sentenced to 30 days in jail after he refused to do community service. Victoria Falls magistrate Rangarirai Gakanje convicted Siyabonga Moyo from Chinotimba suburb of physical abuse and sent him for community service assessment.

However, Moyo told the court that he did not want to do community service because he wanted to take care of his breastfeeding wife and two-week-old baby.

“My wife gave birth two weeks ago so I’ve to take care of her and the infant. I also have a tuck shop to manage and if I do community service, I won’t be able to take care of my family and my business,” Moyo told the magistrate.

This was despite the court having explained to him the elements of community service.

Gakanje sentenced him to an effective 30 days in jail.

Asked why he slapped his wife Moyo said: “I didn’t mean to slap her or cause any harm to her. I was overcome by anger and couldn’t control myself as she is rude,” said Moyo.

Prosecuting Takunda Ndovorwi said Moyo slapped his 19-year-old wife following an argument about the volume of their radio.

“On July 7 at around 12 noon while at their matrimonial home in Chinotimba, the accused slapped his wife after she told him that neighbours had complained that he plays music at high volume at night,” said the prosecutor.

Moyo accused his wife of influencing their neighbours to complain about the noise.

The court heard that Moyo was not happy about his neighbours’ concerns and started by insulting his wife before slapping her.

The victim of domestic violence did not come to court as she has a two-week old baby.
