A Victoria Falls woman who allegedly demanded sex from her younger brother could be mentally disturbed, a magistrate said yesterday as she discontinued trial until her mental state was ascertained. Victoria Falls resident magistrate Sharon Rosemani withdrew indecent assault charges against Abigail Muzamba, 29, of Mfelandawonye who had sought to have sex with her younger brother.
Prosecutors say Muzamba begged her brother Luka, 20, to have sex with her on Thursday last week saying they were both mature.
“It seems you are not well and the state agrees with me. The charges against you are withdrawn until your state of mind is ascertained,” said Rosemani.
Prosecuting, Takunda Ndovorwi had told the court he wanted to withdraw charges.
Luka earlier told the court that Muzamba, who on Monday claimed she felt very cold after being locked in the cells without blankets and could not stand trial, was faking madness because of shame.
However, Muzamba appeared in a loss of senses when she stood in the dock.
The magistrate asked her how she was feeling to which she responded “I don’t know.”
“I hear you were making all sorts of noises…screaming,” inquired Rosemani to which Muzamba expressed ignorance.
The state had alleged that on June 10, Muzamba phoned Luka and told him to come to Victoria Falls urgently saying she had found him a job. They shared a bedroom. On June 12, Muzamba asked her younger brother to share blankets with her and he refused and bolted out of the room seeing that she was determined to coerce him into sex as she was naked.
It is said Muzamba grabbed him begging for sex and the two struggled with each other until Luka fled.
When Luka returned at midnight, his naked sister approached him once again trying to drag him to her blankets and later grabbed an axe threatening to chop him if he refused.
Luka fled and reported the matter to the police leading to his elder sister’s arrest.
