He was convicted after a full trial. Ms Mupindu slapped him with a 20-year prison term but set aside three years on condition of good behaviour.
In passing sentence, Ms Mupindu said the man breached the trust bestowed on him by the girl, as her father. She said rape remains a serious offence and attracts custodial sentence.
The prosecution proved that on January 27 this year at around 12 noon at the house, the girl’s mother left her in the custody of her father as she went out to look for menial work.
The minor entered the house intending to drink some water while he was asleep.
When she was about to go out, he woke up and rushed to the door blocking her and locked the door from inside. He pushed her to the bed before raping her. After the rape, he threatened to assault her if she revealed the ordeal. On March 11, the girl’s mother left the house as she went to attend a church service in Zengeza 3 and he raped her again.
