adminJuliet Kungwengwe filed a protection order application against William Zengweni and his wife Chionei Muyambo.
Kungwengwe told the court that the two families were not staying peacefully as Zengweni and his family were making life unbearable for them.
“I moved to the stand upon realising that the other family was already there. I placed my cabin and this did not go down well with the other family,” she said.
Kungwengwe told the court that Muyambo had resorted to shouting at her from sunrise to sunset. She added that Muyambo also planted onions on her doorstep.
“She made a garden on my doorstep close to my fire place. Every time I start cooking she also starts watering the onions spilling water into my pots,” she said.
The court heard that the dispute between the two families had reached fever pitch as Muyambo threatened Kungwengwe and her child with death. This led her to report the matter to the police.
In their response, the couple who were represented by a lawyer insisted that no violence had been inflicted on the applicant.
“The only issue is that two families are staying at one stand and it is not easy for them to co-exist.The issue of double allocation of the stand was referred to the High Court. In its ruling, the High Court ordered that the two beneficiaries of the stand should stop any construction until the Ministry of Housing has resolved the matter,” she said.
They added that it was Kungwengwe who came to occupy the stand while the couple was already there, breaching their peace. They also indicated that Kungwengwe was supposed to approach the Housing Ministry for a way forward instead of occupying the stand.
Magistrate Tatenda Manhanzva will make a determination on the matter on July 12.
