Adultery counter claim dismissed

A Chimanimani woman who was seeking compensation from her sister-in-law who had an affair with her husband had her case dismissed by the community court, while her husband was ordered to compensate her with one cow.

Sarah Chiripasi (50) accuses her sister-in-law, Loveness Mambeu (23), of breaking her marriage and causing her emotional distress.

For all that, Chiripasi wanted three cattle from Mambeu.

However, Acting Chief Saurombe said Chiripasi was trying to fight in her husband’s corner as he was instructed to compensate his brother with two cattle.

“This is a counter claim because last week, this court ruled that your husband, Taurai Chirongwe, should compensate his brother, Shingai Chirongwe, with two cattle for bedding his wife, Mambeu.

“Now you want the cattle paid by your husband to his brother to return to your family.

“This court does not work like that. We do not fix people, we advise and help them accordingly,” said Acting Chief Saurombe.

He also ruled that Taurai was equally responsible for hurting Chiripasi and ordered him to compensate his wife with one cow.

“I will make your husband compensate you on behalf of his lover by the end of September. I have also found that your husband took advantage of Mambeu because she is young,” said Acting Chief Saurombe.

In her application, Chiripasi said she was stunned by Shingai’s swiftness to pardon his wife, whom she described as a habitual cheat.

Chiripasi defended her husband and accused her brother-in-law of working in cahoots with his wife to bed various men for money.

“He caught his wife bedding other men on two different occasions. I believe this is their money making scheme. I do not know how much he charges them, but I think it is a lucrative venture for the shameless couple.

“Mambeu lured my husband to sleep with him. For that reason I demand three cattle from her,” charged Chiripasi.

After Chiripasi’s outburst, Mambeu threatened to accuse Taurai of raping her.

“I can change goalposts and claim that he raped me because I did not consent to sleeping with him. I was in a trance and only woke up to find him sleeping with me,” she said.

In the previous court session, Mambeu chronicled her escapades with Taurai: “He begged me to sleep with him when we met and I gave in. At first I refused, but I ended up sleeping with him.

“He did not force me, but the truth is that he is the one who proposed that we should be intimate.

“It is not fair for his wife to demand compensation from me, where will I get the three cattle?

“Her husband lured me into bed and promised me some money which he never gave me in the end.”
