Alleged UK fugitive Ndodana Tshuma ‘does not recall’ signing plea agreement, matter postponed

Alleged UK fugitive Ndodana Mkhanyisi Tshuma has told his legal representative that he does not recall signing a plea and sentencing agreement.

Tshuma appeared in the Johannesburg magistrate’s court on Wednesday, where the defence informed the court that it could not proceed because he did not remember signing the agreement, which had been negotiated over several weeks.

The triple-murder suspect pleaded guilty to unlawful possession of a firearm and ammunition and contravention of the Immigration Act by entering South Africa as a fugitive sought by the UK.

Tshuma, a 45-year-old British citizen of Zimbabwean heritage, also known as Mark, is wanted by Bedfordshire police in connection with the murders of his wife, Zandile, 42, and their daughters, Natalie, 15, and Nala, five.

After fleeing the UK on July 4, he was arrested by South African police in Kensington, Johannesburg, on July 10. He was allegedly found in possession of an unlicensed 9mm firearm.

Tshuma is also facing extradition proceedings in connection with the three murders following a request from the UK.

His lawyer Chrispin Machingura told the court that Tshuma had also complained about not sleeping properly and that he was unable to provide clear instructions, suggesting the need for a medical evaluation.

The defence said it could not proceed without clarity from Tshuma on whether he acknowledged the agreement or not.

The proceedings have been postponed to October 29 for Machingura to receive further instructions.
