Yekeye was found guilty after the prosecution proved its case beyond reasonable doubt.
Ms Mugwagwa sentenced him to 20 months in prison but set aside four months for the next five years on usual conditions. A further 10 months were suspended on condition he pays US$3 900 to Fungai Sithole (33). The remaining six months were suspended on condition he completes 210 hours of unpaid work at Warren Park Police Station.
Prosecutor Mr Tendai Mukariri proved that sometime in June last year, Sithole went to Yekeye’s work place where they entered into an agreement that the latter would sell his car, a Nissan Terrano.
The two parties agreed that Sithole would come to collect his money after three weeks.
After two months, Sithole was transferred to Bulawayo and he would call Yekeye checking whether the car was bought. On September 29 the same year, Sithole returned from Bulawayo and tried to see Yekeye who became evasive.
When Sithole called him on another day, he was told that the car was being sold at Top Gear car sale.
Unsatisfied with the response, Sithole approached the car sale where he discovered that his car was already sold to the garage owner.
This prompted him to report the matter to the police leading to Yakeye’s arrest.
