A HARARE man has approached the High Court with an application for a declaratory order and mandatory injunction against Mr Nelson Chamisa over accountability of assets acquired during his time as an active leader of the CCC party and before he can found yet another party.
In papers filed under case HCH498/26, Mr Talent Rusere is demanding accountability of finances and resources the opposition party got under Mr Chamisa’s stewardship, alleging he exercised “absolute control over CCC resources” through the policy of “strategic ambiguity” which allowed him to effectively by-pass formal party treasuries.
By having absolute control of CCC, Mr Chamisa “acted as a constructive trustee over the financial resources” of the party and “is personally liable to account for the same”.
Mr Rusere said necessitating an interdict against Mr Chamisa and his agents sought “to prevent the registration of new political entities until a certified audit is complete” as there was “well-grounded apprehension of asset flight”.
He added that he was demanding accountability of over $122 000 that was raised through the GoFundMe crowdfunding platform to buy Mr Chamisa a bullet-proof vehicle, a position that then CCC spokesperson Ms Fadzayi Mahere confirmed the party would uphold.
“This asset was purchased for the respondent’s use, as confirmed by his spokesperson in Annexure B. The respondent’s failure to account for this asset is prima facie evidence of breach of trust. He is legally bound to account for all assets administered during his tenure,” Mr Rusere’s application reads.
He accused Mr Chamisa of trying to use agents and associates to register a new political entity with the Zimbabwe Electoral Commission to shield current assets from liabilities.
Mr Chamisa is expected to file his notice of opposition and opposing affidavits within 10 days, without which the matter will be dealt with in his absence.
