Despite DNA tests confirming that Kudzai Masara was looking after a baby boy that is not his, ex-wife Rutendo Chinyati was acquitted of charges of wilfully providing false information for the purposes of registering a child.Chinyati (22) who had her marriage wrecked by the WhatsApp message left the Mutare Magistrate’s courts all smiles after Magistrate, Miss Venencia Mugota declared her free.
Miss Mugota went on to tell Chinyati that if she was disputing the paternity results, she was free to explore other avenues.
“The charge you are facing is that of wilfully supplying false information for the purposes of registering a child and in passing judgment I consider the aspects of willingness and that of false information.
“The State failed to prove beyond reasonable doubt that you willingly provided false information for the purposes of registering the child Anesu.
“This child was born inside wedlock and at the time of his registration, chances are that Kudzai Masara could have been the father as is supported by the Shona adage which says ‘Gomba harina mwana’.
“The birth certificate was also attained with the consent of both parties. I hereby find you not guilty and you are acquitted. If you want to contest the paternity results, you are free to explore other avenues,” said magistrate Mugota.
Chinyati’s alleged promiscuity prompted the Masara family to carry out DNA tests which revealed that the child that had been born during her marriage to Kudzai was not a Masara.
The results showed zero percent probability that Masara could have been the father to Chinyati’s child.
