Tawanda Nyamadzawo Mandidzinga (41) is now facing a charge of defeating or obstructing the course of justice.
He was not formally charged when he appeared before a Harare magistrate Mr Donald Ndirowei who remanded him out of custody to November 18 on US$20 bail.
The State had opposed bail.
Mr Ndirowei ruled in favour of the defence.
Prosecutor Mr Tinashe Kasema alleges that on November 1, vendors along Nelson Mandela Avenue opposite Harvest House, the MDC-T headquarters, assaulted police officers who tried to arrest them for selling pirated CDs.

Assistant Inspector Zhawarara and officers from police reaction group, rushed to the scene and the vendors fled and sought refuge in Harvest House.
Mandidzinga was manning the main entrance.
He allegedly allowed the vendors inside the building before locking the main entrance to bar police from entering.
Asst Insp Zhawarara allegedly ordered Mandidzinga to open the gate but he refused and walked away.
He later came back with his superior a Mr Hokoto who then opened the gate for the officers, says the State.
When they got inside the building, the policemen allegedly failed to locate the vendors as they had escaped through the back entrance. Mandidzinga was then arrested.
