Commission calls for public submissions

THE Commission of Inquiry into Harare City Council Governance is inviting members of the public to submit written submissions relating to the city’s financial affairs, including revenue collection and procurement.

President Mnangagwa recently appointed and swore in the commission, chaired by retired High Court judge Justice Maphios Cheda, to investigate Harare City Council’s local governance issues, with emphasis on financial affairs, since 2017.

The appointment was made in the Constitutional proclamation contained in Statutory Instrument 91 of 2024 to establish a Commission of Inquiry to investigate Harare City Council.

In a statement, Justice Cheda appealed to the general public to submit written documents on information they have in various aspects of governance by the local authority.

“The terms of reference for this inquiry include examining financial management systems, compliance with procurement laws, the management of revenue through special vehicle companies, and other pertinent issues.

“As part of the commission’s comprehensive investigation, we are seeking written submissions from all Harare City Council stakeholders including, but not limited to residents who have insights or information relevant to our mandate. Your expertise and perspective are invaluable to us in understanding the complexities and challenges faced by the Harare City Council.

“We kindly invite you to provide a detailed written submission addressing any or all of the following areas which include: Financial management systems and audit compliance, compliance with the Public Finance Management Act and other relevant laws,” said Justice Cheda.

He underscored the need for contact information and any relevant documentation that supported submissions.

Other areas under investigation include revenue management, which is the financial management of revenue generated through special vehicle companies, and outsourced arrangements.

The lack of the needed enterprise resource planning system is being investigated, along with the reasons for the failure to operate such an advanced accounting system and the quantification of any resultant losses.

The commission is digging into property management procedures, including the procedures for the management, sale, lease, or transfer of council properties to private entities. 

The convening of council meetings and adherence to standing orders and rules and the compliance with the Public Procurement and Disposal of Public Assets Act, along with any other issues related to the management of Harare City council, are also under investigation.

Justice Cheda said submissions should be sent through the commission’s office and addressed to the chairperson at Old Makombe Building (Reception), situated at corner of Herbert Chitepo Avenue and Harare Street in Harare.

The deadline for public submissions is June 5. Justice Cheda said the participation of the general public was important as it delved into the council.

“Your participation will contribute significantly to the commission’s efforts to ensure accountability and transparency within the Harare City Council. Should you have any questions or require further information, please do not hesitate to contact our office or via email,” he said.

The other commissioners are: Mr Steven Chakaipa, Mr Norbert Phiri, Mrs Lucia Gladys Matibenga and Ms Khonzani Ncube, while the Permanent Secretary for Local Government and Public Works Dr John Basera is the Secretary.
