Brance says the total cost of the services rendered as well as the material used amounted to US$92 621,50.
Mutodi allegedly paid part of the money leaving a balance of US$39 743,19.
Despite demand by the construction company, Mutodi had failed or refused to pay the full amount prompting the company to file a claim at the High Court.
Brance contends that the only option was to seek redress from the High Court.
The company wants Mutodi to pay the outstanding money together with interest at the prescribed rate of five percent per annum from February 2012.
Manase and Manase law firm is acting for the construction firm in the law suit.
Mutodi instructed Mr Tendai Hangazha of Hangazha and Partners, who filed a notice of appearance to defend.
The case is yet to be set down for pre-trial conference at the High Court.
