Cop murder case: Bail appeal struck off roll

The seven were arrested for allegedly murdering Inspector Petros Mutedza in Glen View mid this year.

Deputy Chief Justice Luke Malaba threw out the appeal on the basis that lawyers representing the seven had flouted the procedure followed in filing an appeal.
It was the Supreme Court’s finding that the seven were supposed to first seek leave to appeal at the High Court before appealing against denial of bail at the superior court.
Tungamirai Madzokere, Lazarus Maengahama, Stanford Maengahama, Phineas Nhatarikwa, Stanford Mangwiro, Yvonne Musarurwa and Rebecca Mafukeni remained in custody after the Supreme Court refused to hear the bail application.

The seven’s lawyers have to go back to the High Court and make an application for leave to appeal before approaching the Supreme Court again with an appeal.
More than 15 other suspects were granted bail by the High Court, but the seven have twice lost their bid for freedom.

Justice Tendai Uchena was the first to throw out their bail application on the basis that they were a flight risk.
They mounted a fresh application based on what they believed to be changed circumstances but Justice Samuel Kudya again dismissed the application.

The six had now approached the Supreme Court challenging the initial dismissal of bail by Justice Uchena.
Law officer Mr Edmore Nyazamba from the Attorney General’s Office appeared for the State while Mr Charles Kwaramba of Mbidzo, Muchadehama and Makoni represented the seven.
