Council employee files for divorce

A WOMAN, who recently caused a stir at the Harare Civil Court seeking protection against someone she accused of dating her lover, has filed for divorce at the High Court.

In the matter, HC2129/22, Rita Chipo Barbara Mugocha,45, is seeking to divorce her husband, Eugene Gaston Mugocha.

 

The divorce application was filed on March 30 this year before Justice Amy Tsanga.

 

The parties were married under the Marriages Act (Chapter 5:11) in March 2006.

 

Rita dragged a woman, identified only as Vimbai,30, to the Harare Civil Court, accusing her of spreading rumours that she was involved in land scams at the City Council.

 

It also emerged in court that Rita, who is a principal town planner, was insulting Vimbai over her lover, Elton Kudzai Maw0ndo (33) whom they both dated.

 

Dzingirai alleged Mugocha was conniving with Mawondo.

 

Eugene applied for a peace order against Rita before magistrate Sharon Mashavire, who advised them to resolve their dispute amicably.

 

However, Rita and Eugene agreed that their marriage had irretrievably broken down and there were no reasonable prospects of restoration.

 

Rita has issued summons against Eugene demanding a decree of divorce.

 

Reads part of the application:

 

“And, whereas the parties have resolved all the issues to the divorce.

 

“Now, therefore, it is recorded that in contemplation of and subject to this court granting a decree of divorce, the parties hereto have consented to the terms herein being incorporated in such a decree of divorce.

 

“The marriage relationship between the parties was blessed with three children of which two are still minors. 

 

“The parties have lost love and affection for each other and have moved on with their separate lives.

 

“The parties have not lived together as husband and wife from January 2016 to date. 

 

“Thus, the parties have not consummated their marriage for an uninterrupted period of six years.”
