Councillor challenges shop construction

Councillor Didymus Bande of Ward 4, has filed an application at the High Court seeking an order to bar the construction of a shop by Malcon Investments at Stand Number 2001 Chizunyu Township.
If the structure is already in place by the time the judgement is granted, it should be demolished. Construction was already underway when the application was filed at the High Court last week on Thursday.
Clr Bande stated in the application that he was representing the Chizunyu Residents Association in Epworth.
The membership, according to Clr Bande, has castigated the construction of a building at the stand adding that it was land reserved for a terminus and that it was too close to the road.
He claims it was his obligation to act on societal problems and in the matter in question he had been granted green light to represent the association.
Epworth Local Board that allocates and approves land development in the area was cited as second respondent in the application.
“This is an order to immediately stop first respondent (Malcon) from erecting any structure on a piece of land described as number 2001 Chizunyu Township, Epworth.
“In the event that there is a structure already erected on the said piece of land, second respondent (Local board) should be empowered to demolish it,” read the papers.
It was suggested that council should allocate Malcon Investments an alternative business stand at a proper area of the same size.
Clr Bande argues that the land in dispute should be left vacant, as it was unsuitable for construction of any building.
Allowing Malcon to construct the shop, according to Clr Bande, was against public interest and that no one should be allocated that land again.
