THE High court has issued a prohibition order against a group that was seeking to take-over the running of the Commercial Workers Union of Zimbabwe (CWUZ), as the court moves in to end a six-year factional and leadership fight that had erupted in the labour body.
Justice Benjamin Chikowero recently ordered David Tunhira, Godwin Munjoma, Farai Mupango, Takawira Masocha, Morgan Gumede, Wellington Ncube, Lameck Makwenjere and Phelystus Wazulu to stop masquerading as CWUZ leaders.
The court also nullified a CWUZ congress held in 2013 that brought in new leaders, worsening the power squabbles that can be traced to 2005 when two factions emerged.
The two factions took their case to the high court recently where Justice Chikowero ruled that; “The CWUZ constitution has no provision relating to co-presidents and the 4-6 July 2013 congress was ultra vires the provisions of the CWUZ constitution and therefore is null and void.”
“The eight, (Tunhira, Munjoma, Mupango, Masocha, Gumede, Ncube, Makwenjere and Wazulu), are interdicted from acting on behalf or using any of the CWUZ property including letter heads.”
CWUZ Harare region national executive member, Mr Kudzanayi Chikazhe said the court ruling was positive as it would bring order, allow the holding of a congress and smooth election of leaders.
“The executive has already started planning for a congress and implementing all recommendations of the high court,” he said.
“We are in the process of creating structures, because according to the constitution, we should have branches from where members are elected from.”
