A GOLD dealer who threatened to kill a prominent businessman in a dispute over payment has been handed a wholly suspended six-month jail term, bringing closure to a case that unfolded in the presence of a retired High Court judge.
Mohamed Daka was convicted of issuing death threats against Bulawayo businessman, Mr Bekezela Moyo, after a meeting between the two turned violent in July this year.
The confrontation occurred at the offices of retired High Court judge Justice Maphios Cheda, who later became a key witness in the criminal case.
Daka’s six-month imprisonment was wholly suspended on condition that he does not commit a similar offence and maintains good behaviour.
According to evidence presented in court, Daka and Mr Moyo had convened at Justice Cheda’s offices to resolve a payment dispute relating to services rendered by Mr Moyo.
The discussion deteriorated, leading to Daka issuing chilling threats.
“I wanted to kill you before, but now I am going to kill you. I am following you with your family everywhere. I have people following you and watching your house,” Daka said.
Mr Moyo subsequently reported the matter to the police. Justice Cheda submitted a written statement describing the altercation and supporting the complaint.
In addition to the criminal case, Mr Moyo has lodged a US$250 000 civil suit against Daka for alleged defamation.
Through his lawyer, Mr Bruce Masamvu of Masamvu and Da Silva-Gustavo Law Chambers, Mr Moyo is seeking US$150 000 for damages to Allied Security, and US$100 000 in personal damages.
The claim is based on allegations that Daka circulated a WhatsApp voice note accusing Mr Moyo of attempting an armed robbery at Pottery Industries and labelling him a “convicted armed robber.”
