Dr Kanyenze sues late patient’s hubby

THE intriguing drama between Mutare gynecologist and obstetrician, Dr Miriam Kanyenze, who is alleged to have caused the death of Mrs Miriam Makunura from Nyanga in 2010, has spilled into the courts of law again, with the doctor claiming defamation of character damages against her late patient’s husband.

Through her lawyers, Chibaya and Associates, Dr Kanyanze has filed $10 000 damages against Mr James Makunura, arguing that the senior citizen had tarnished her image as he portrayed her to the community as a negligent doctor.

This follows recent revelations that a Cuban doctor and not Dr Kanyenze had negligently discharged his duties resulting in the death of Mrs Makunura in July 2009. Since the death of his wife, Mr Makunura has waged a spirited war against Dr Kanyenze and has gone as far as the Parliament of Zimbabwe, the Prosecutor-General and Police Commissioner-General’s offices seeking justice.

In a recent interview, Mr Makunura, said Dr Kanyenze was supposed to pay him $28 000 as compensation for all his expenses, for the medical bills, funeral and the bride price he had paid his in-laws, but the money now has interests amounting at about $40 000, making a total of $68 000 since she never paid anything.

However, in an intriguing turn of events, Dr Kanyenze has taken the war to Mr Makunura’s door step seeking compensation for the damage he has allegedly done to her reputation. This follows recent revelations that Dr Kanyenze had professionally carried out a surgical operation on the late Mrs Makunura in July 2009, but a Cuban General Medical Officer, a Dr Lewis was the one who had failed to properly execute his duties.

In a letter from the registrar of the Medical and Dental Practitioners Council of Zimbabwe, the registrar, Mrs Josephine Mwakutuya dated August 19, 2013, addressed to Dr Kanyenze, it reads: “The chairman announced the judgment as follows, ‘The committee has considered what you have submitted in mitigation and the committee also takes note of the very difficult conditions that you work under and you took responsibility of the actions of your GMO.

“You are thereby reprimanded. It is your responsibility to make sure that the patients under your care are taken care of properly.”

Dr Lewis who used to work at Mutare Provincial Hospital went back to Cuba before March 1, 2010 when Mrs Makunura went back to Mutare Provincial Hospital complaining of abdominal pains and bleeding problems.
