A DRUNKEN man invited the wrath of the law when he slipped into his daughtera��s blankets, fondled her buttocks and breasts before fingeringA� her a�?cookiea�� while his wife was fast asleep in their bedroom.
The forbidden antics transpired on Christmas Eve when the man, who cannot be named to protect the identity of the child, decided to spoil himself with an unthinkable Christmas present.
The man appeared before Hwange magistrate Portia Mhlanga-Moyo facing a charge of indecent assault and pleaded guilty to the charge.
Magistrate Mhlanga slapped him with 24 months imprisonment in which 12 months of imprisonment were suspended for five years on condition that he is not convicted of an offence of which Section 67 of the code is an element.
Another 12 months were set aside on condition that he completes 420 hours of community service at Dete ZRP.
The guilty father told the court that he could not relate to the events of the fateful night and pleaded with the magistrate to be forgiven.
a�?I never intended to do that, I dona��t know what happened I was drunk. Ia��m sorry for my actions, I wish I could be given a chance to pay school fees for my kids and take care of my family,a�? he said.
Prosecuting, Loveness Maseko told the court that on December 24, 2016 at around 2am, the accused got home drunk and slipped into his daughtera�� blankets and started caressing her body.A� She had come for a Christmas visit. He fondled her breasts, buttocks and privates without her consent.
The complainant advised her father to stop fondling her and he left proceeding to his bedroom. In the morning the complainant told her stepmother about what transpired the previous night and she brushed it away.
Acting on a tip-off, police investigated the case and a report was filed at ZRP Tshabalala. The complainant was taken for medical examination and the report was produced as evidence.
