AFRO-JAZZ sensation Duduzile Tracey Manhenga’s bail application hearing at the High Court was yesterday deferred to today. Justice Felistus Chatukuta deferred the hearing to allow the State to file its response to the application. Manhenga is seeking to be released from prison pending determination of her appeal against the 18 month jail term imposed on her after being convicted for culpable homicide and driving without a licence.
She unsuccessfully applied for bail at the magistrates’ courts last week, which prompted her to approach the High Court for relief.
Last week the hearing was postponed after Justice Hlekani Mwayera noted that the musician’s lawyers had not provided the court with a transcribed record of proceedings.
The defence only filed a record that was written in long hand, which the court felt was not legible enough. The court also wanted the musician to file an original notice of appeal and to properly paginate the record.
Manhenga was sentenced to a 24-month jail term by the Harare Magistrate’s Court but six months were set aside for five years on condition that she does not commit a similar offence.
The Color Blu crooner was also fined US$300 (or three months in prison) for driving without supervision. An additional six-month jail term was wholly suspended on condition that she does not drive without supervision for the next five years.
