DETAINING and forcing an employee to sign the termination of employment contract on three months’ notice landed FoodWorld management in court. Nunurai Tambala, Kudzai Tuso, Union Masvingise and Darlington Forichi appeared before Harare magistrate Ms Sharon Rakafa facing kidnapping charges, but the matter was withdrawn before the court at the instigation of the complainant.
The complainant Joseph Sibanda of Highfield in Harare told the court that he had agreed on an out-of-court settlement. The prosecutor Mr Desire Chidanire told the court that on July 7 this year the quartet called Sibanda to FoodWorld located along Angwa Street. They wanted to calculate his terminal benefits.
Sibanda was given a form with his total benefits which they ordered him to sign. After studying the form Sibanda refused to sign and demanded to consult his lawyer first. Tambala and Tuso refused to let Sibanda go with the form to his lawyer and their colleagues Masvingise and Forichi then gave Tambala office keys to lock Sibanda inside.
He was detained in the office for an hour and the quartet demanded that he gives them back the terminal benefits form. Another two hours elapsed and the quartet handed over Sibanda to security guards to watch him. Around 3pm Tambala and Tuso ordered Sibanda to give them the terminal benefits form so that it could be photocopied.
The form was given to the company secretary and before she could make the copies, the form was snatched from her by Tuso. The court heard that Tuso stashed the form in her bra. Afterwards the quartet let Sibanda go after detaining him for three hours.
