STAYING in Zimbabwe knowing very well that his travel documents had expired landed an Equatorial Guinea citizen in court last Friday.Mohamed Tounkara (42) appeared in court facing two counts of contravening Section 29(1) (a) of the Immigration Act, Chapter 4:02 (An alien shall not enter, or remain in Zimbabwe unless if he is in possession of a permit permitting him to enter or remain in Zimbabwe, as the case may be.)
The court heard that on January 6, Tounkara was arrested for entering Zimbabwe through the Forbes Border Post without the valid documents that allowed him to do so.
On the very same day after being deported, Tounkara again made his way into Zimbabwe, thereby contravening Section 34(1) (b) of the Immigration Act, Chapter 04; 02 (Any person who has been removed from or ordered to leave Zimbabwe or has not been authorised in terms of this Act to enter or remain in Zimbabwe and who is found within Zimbabwe shall be guilty of an offence unless he is in possession of a permit authorising him to enter or remain in Zimbabwe).
Mutare senior magistrate Mrs Sekai Chiundura convicted Tounkara on his own plea of guilty and ordered him to pay a fine of $150 and remain in custody till deportation.
Mr Donald Mudarirwa represented the State while Mr Farai Matinhure of Gonese and Ndlovu Legal Practitioners appeared for Tounkara.
