In an estate wrangle that has spilled into the courts, a Mutare man is insisting that since his brother is now late, his widow should return to her parents’ house with her three minor children and move on with her life.
The matter was heard at the Mutare Magistrate’s Civil Court before Mr Xavier Chipato as Tafadzwa Mariyano applied for a protection order against her brother-in-law, Gibson Chemwaita.
The protection order was granted in Mariyano’s favour.
Mariyano told the court that ever since her husband’s death, Chemwaita has been telling her to return to her parents’ house.
She also told the court that she stays on some land that was handed to the couple by her deceased husband’s parents before they passed on.
“We were given that piece of land by my husband’s parents to build our own house and till the land but when my husband passed on, my brother in-law told us to vacate. I have nowhere else to go with my children,” said Mariyano.
She also revealed that Chemwaita wanted her to become his wife and she refused, hence their strained relationship.
She went on to tell the court that Chemwaita is in the habit of harassing her as he comes to her place of residence at midnight telling her to vacate the house.
He also allegedly accuses her of causing the death of her husband.
Chemwaita told the court that as a young woman, Mariyano should return to her parents’ house.
“When my brother passed on, we agreed as a family that Mariyano would return to her parents since she is still young. Imagine, she is still at our place and is seeing someone, which is an abomination in our culture.
“When I confronted her over this issue, that’s when she filed for a protection order against me,” said Chemwaita.
Mr Chipato ordered Chemwaita not to harass, insult or disturb his sister-in-law’s peace.
